TERMS & CONDITIONS

1. Booking & Payment Terms

1.1. A non-refundable booking fee of 50% is required to secure the booking date.

1.2. The remaining balance is due within 14 days of the invoice date, unless otherwise agreed in writing.

1.3. All prices are quoted in Australian dollars (AUD) and exclude GST.

2. Late Payments

2.1. Payments not received within 14 days of the invoice date will incur interest of 5% of the total invoice amount per week (or part thereof) until payment is received in full.

2.2. The Photographer reserves the right to withhold delivery of images until all outstanding balances, including interest, are paid in full.

3. Cancellation & Rescheduling

3.1. Cancellations made more than 5 business days before the booking date will forfeit the booking fee but will not incur additional charges.

3.2. Cancellations made within 2 business days of the booking date may be charged up to 50% of the total agreed fee.

3.3. Rescheduling is subject to the Photographer’s availability and must be agreed upon in writing.

4. Copyright & Usage

4.1. The Photographer retains full copyright and moral rights to all images.

4.2. The Client is granted a non-exclusive licence to use the final edited images for agreed-upon purposes (e.g., lookbook, campaign, social media, press, etc.).

4.3. Any additional or commercial usage outside the original agreement requires written consent and may incur an additional fee.

5. Image Delivery

5.1. Edited images will be delivered within 7 business days of the shoot, subject to timely payment.

5.2. All images are delivered digitally unless otherwise arranged.

5.3. The Photographer does not guarantee storage of images beyond 3 months after delivery.

6. Liability

6.1. The Photographer will take all reasonable care but will not be liable for loss, damage, or delay beyond their control (e.g., equipment failure, illness, force majeure).

6.2. In the unlikely event the Photographer cannot fulfil the booking, all fees paid will be refunded in full, and no further liability will be accepted.

7. General

7.1. These Terms and Conditions are governed by the laws of the State of Victoria, Australia.

7.2. Any variations to these Terms must be agreed upon in writing by both parties.

8.Equipment Hire

8.1 All equipment provided for use during the booking remains the property of the Photographer. The Client assumes full responsibility for the proper and safe use of all equipment during the hire period. In the event that any equipment is lost, stolen, damaged, or otherwise rendered unusable while in the Client’s control, the Client agrees to replace the item(s) with the identical make and model at their own cost, or reimburse the full replacement value if the same item is no longer commercially available. The Photographer reserves the right to invoice the Client for the full replacement cost, due within the standard invoice payment terms.
